Overview

Welcome to Online Thrift Superstore.

Online Thrift Superstore LLC, referred to in these Terms as “Online Thrift Superstore,” “OTS,” “we,” “us,” or “our,” operates this website and online store, including the related information, content, features, tools, products, and services made available through it collectively, the “Services.”

Our Store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping & Freight Policy, individual product listings, offer or invoice terms, and any other policies or terms expressly incorporated by reference, collectively govern your access to and use of the Services.

Please read these Terms carefully. They contain important information about your rights and responsibilities, including provisions concerning product condition, one-of-one inventory, warranties, returns, limitations of liability, and dispute jurisdiction.

By visiting, browsing, interacting with, creating an account on, submitting an offer through, or purchasing from the Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable law.


Section 1 — Access, Eligibility, and Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence.

If you permit a minor dependent to use the Services through a device, account, or payment method you own or manage, you are responsible for that use to the extent permitted by law.

If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

You may be asked to provide information such as your:

  • Name
  • Email address
  • Telephone number
  • Billing information
  • Payment information
  • Shipping address
  • Account credentials

You represent that all information you provide is accurate, current, complete, and lawfully provided.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Restricting unauthorized access to your account
  • Activity conducted through your account
  • Promptly updating inaccurate or outdated account information
  • Notifying us if you believe your account has been compromised

You may not sell, transfer, assign, license, or provide another person with unauthorized access to your account.

We may require additional identity, address, payment, or order verification when reasonably necessary to prevent fraud, confirm authorization, protect customers, comply with law, or safely complete a transaction.

By providing an email address or telephone number, you agree that we may send you transactional communications concerning your account, orders, offers, returns, reviews, shipping, or customer-service inquiries. Marketing communications are subject to your applicable choices and opt-out rights.


Section 2 — Products, Listings, Condition, and Testing

Online Thrift Superstore sells a changing assortment that may include:

  • New merchandise
  • Open-box merchandise
  • Pre-owned merchandise
  • Customer returns
  • Overstock merchandise
  • One-of-one items
  • Vintage or collectible items
  • Parts / Repair merchandise
  • Other lawfully acquired products

Many items are unique and have an available quantity of one.

Listing accuracy

We make reasonable efforts to identify, photograph, grade, test, and describe products accurately.

A product’s individual listing may include information such as:

  • Item type
  • Condition Grade
  • Testing Status
  • Actual-item or representative photographs
  • Cosmetic notes
  • Testing notes
  • Known issues
  • Included accessories and components
  • Serial-number suffix or other identifying information
  • Shipping classification
  • Return eligibility

These product-specific disclosures form part of the applicable product listing and purchase terms.

The individual product listing controls over a general condition definition when the listing provides more specific information about that particular item.

Condition Grade and Testing Status

Condition Grade and Testing Status describe different things.

Condition Grade generally describes the item’s physical or cosmetic state.

Testing Status describes the level of functional verification we performed.

An item may appear cosmetically excellent while remaining untested. An item may show significant wear while having had its major functions tested.

A Testing Status describes what was observed at the time of testing. It is not a promise that the product will continue functioning indefinitely or that every possible feature, setting, port, accessory, or use case was tested.

Photographs

A product listing may identify photographs as:

  • Actual Item
  • Representative
  • Manufacturer + Actual Item

When a listing states that photographs show the Actual Item, the photographs are intended to depict the physical unit being offered.

Representative or manufacturer imagery may be used where clearly identified, including for standardized, identical, or factory-sealed inventory.

Lighting, camera settings, image compression, screen settings, and device configuration may cause colors or apparent details to vary slightly.

Minor photographic or display differences are not necessarily a material listing error. Material differences remain subject to our Refund Policy.

Included items

Only accessories, components, packaging, documentation, or other items expressly shown or identified as included should be assumed to accompany the product.

Background objects, display stands, staging materials, furniture, or accessories appearing in photographs are not included unless the listing says otherwise.

Parts / Repair merchandise

Products identified as Parts / Repair, Nonworking, or similarly described may be damaged, incomplete, untested, partially functional, or known not to operate normally.

No representation is made that a Parts / Repair item can be repaired or that any particular internal component works unless the listing expressly says so.

The general Parts / Repair designation does not replace item-specific Known Issues or other disclosures.

Manufacturer warranties

Unless a listing expressly states otherwise, do not assume that:

  • A manufacturer warranty remains active
  • A warranty is transferable
  • Online Thrift Superstore is an authorized manufacturer retailer
  • Manufacturer support, registration, service, or replacement will be available

Any manufacturer warranty is provided solely by the applicable manufacturer under its own terms.

Right to sell

We represent that we have the right or lawful authority to offer the merchandise listed through our Store.

We may discontinue, withdraw, revise, or limit a product or product quantity at any time before a completed purchase, subject to applicable law.


Section 3 — Orders, Acceptance, and Inventory Availability

Placing an order constitutes an offer by you to purchase the products identified in the order.

An automated order acknowledgment, payment authorization, or checkout confirmation does not prevent us from reviewing or canceling the transaction before fulfillment when reasonably necessary.

We may accept, decline, restrict, or cancel an order for lawful reasons, including:

  • The item is no longer available
  • Inventory sold through another authorized sales channel
  • An inventory synchronization delay occurred
  • Pricing or product information was materially incorrect
  • Payment could not be authorized or verified
  • We reasonably suspect fraud or unauthorized payment
  • Required customer or shipping information cannot be verified
  • The destination is unsupported or restricted
  • The order violates these Terms or another applicable policy
  • The order would violate applicable law
  • We cannot safely or reasonably fulfill the order
  • A product is subject to item-specific sale requirements

Because some products are one-of-one and may be listed simultaneously through Shopify and authorized third-party marketplaces, two customers may attempt to purchase the same physical item before all systems finish updating.

A product is not guaranteed to a customer until payment has been completed and the order has been accepted through the applicable checkout process.

If we cancel an order after collecting payment, we will issue a refund of the amount charged to the original payment method. The time required for the refund to appear depends on the financial institution or payment provider.

We may limit purchase quantities on a case-by-case basis.

You may not use the Services or purchase products:

  • With stolen or unauthorized payment information
  • For an unlawful purpose
  • In violation of export-control, sanctions, customs, or trade laws
  • As part of fraud, money laundering, payment abuse, or other illegal activity

You may request an order cancellation, but cancellation is not guaranteed after an order enters processing, fulfillment, or shipment.

Section 4 — Name Your Price Offers

Selected products may include a Name Your Price option.

An offer is not an order

Submitting a Name Your Price offer:

  • Is not a completed purchase
  • Is not an accepted order
  • Does not reserve inventory
  • Does not prevent another customer from purchasing the item
  • Does not require us to accept, counter, decline, or respond

We may accept, counter, decline, or allow an offer to expire at our discretion.

Acceptance and counteroffers

If we accept an offer or send a counteroffer, we may provide a secure Shopify invoice, checkout link, customer-account action, or other authorized payment method.

An accepted offer or counteroffer remains available only until:

  • Its stated expiration time, or
  • The product is sold to another customer,

whichever occurs first.

Unless expressly stated otherwise, an accepted offer or counteroffer does not reserve the product.

Payment wins. An offer does not hold inventory.

Only completed payment through the authorized checkout process claims the available inventory.

Availability

If the product sells before you complete payment:

  • The offer becomes unavailable
  • The invoice or checkout link may stop working
  • We are not obligated to provide a substitute
  • We are not obligated to honor the negotiated price on another item

Because many products are unique, an identical replacement may not exist.

Personal and nontransferable offers

An accepted offer or counteroffer is intended only for the customer and contact information associated with that offer.

You may not:

  • Transfer an accepted offer to another person
  • Alter or manipulate an offer link
  • Change the negotiated amount
  • Use another customer’s offer
  • Combine the negotiated price with another discount unless expressly allowed
  • Reuse an expired or completed offer

Errors and abuse

We may cancel or correct an offer affected by:

  • A technical error
  • A pricing error
  • An inventory error
  • Unauthorized access
  • Fraud
  • Automated abuse
  • Manipulation of the offer or checkout system

If a negotiated order is canceled after payment has been collected, we will issue an appropriate refund to the original payment method.

We may restrict access to Name Your Price for customers who repeatedly submit abusive, fraudulent, automated, or clearly non-genuine offers.


Section 5 — Prices, Promotions, Taxes, and Billing

Prices, discounts, compare-at prices, promotions, and product availability may change without notice before an order is completed.

The price charged will generally be the price displayed and accepted during checkout or through an authorized negotiated-price invoice.

Unless expressly stated otherwise, displayed product prices do not include:

  • Sales tax
  • Shipping
  • Handling
  • Freight charges
  • Customs duties
  • Import taxes
  • Brokerage fees
  • Other destination-based charges

Applicable taxes and charges may be calculated during checkout, quoted separately, or collected as otherwise required.

Promotions may have separate eligibility requirements, expiration dates, exclusions, or terms. If promotion-specific terms conflict with these Terms concerning that promotion, the promotion-specific terms control.

Discounts and negotiated prices may not be combined unless expressly permitted.

You agree to provide current, complete, and accurate billing and payment information.

You represent that:

  • You are authorized to use the payment method provided
  • The payment information is accurate
  • Charges you authorize may be submitted for payment
  • You are responsible for applicable taxes, shipping, and other disclosed charges

A payment authorization does not guarantee that an order will be accepted or fulfilled.


Section 6 — Shipping and Delivery

Shipping estimates

Shipping, processing, and delivery dates are estimates unless expressly guaranteed in writing.

We make reasonable efforts to ship within the time stated in the applicable listing, checkout, order confirmation, or shipping policy.

If we cannot ship within the represented time, we will provide any notice, delay-consent option, cancellation option, or refund required by applicable law.

Customer-provided information

You are responsible for providing a complete and accurate shipping address.

We are not responsible for delays, losses, or additional charges caused by:

  • An incorrect or incomplete address
  • An unauthorized address change
  • Refusal of delivery
  • Failure to retrieve a held package
  • Failure to cooperate with the carrier
  • Inaccurate freight-delivery information
  • Customs delays attributable to the recipient
  • Instructions you provide directly to the carrier

We may contact you to verify or correct shipping information before fulfillment.

Carrier delays

Carriers and third-party logistics providers may experience delays beyond our reasonable control.

Subject to applicable law and our stated policies, we are not responsible for delay caused solely by:

  • Severe weather
  • Natural disasters
  • Labor disruptions
  • Carrier network interruptions
  • Customs processing
  • Government action
  • Emergencies
  • Other events beyond our reasonable control

Risk of loss

Unless applicable law or a separate written agreement provides otherwise, risk of loss remains with us until the order is delivered to the shipping address provided during checkout or accepted by the customer at pickup.

This does not make us responsible for loss caused by an incorrect address, unauthorized delivery instruction, customer-directed carrier change, or other act attributable to the customer.

High-value shipments

High-value merchandise may require:

  • Signature confirmation
  • Adult signature
  • Identity verification
  • Address verification
  • Restricted delivery
  • Additional insurance or carrier services

A customer’s inability or refusal to complete a disclosed delivery requirement may delay delivery or result in the order being returned.

Transit damage and missing packages

If merchandise arrives damaged or a shipment appears missing, contact us promptly.

For damaged shipments, preserve:

  • The item
  • Shipping box
  • Internal packaging
  • Shipping label
  • Freight materials
  • Photographs of the condition in which the shipment arrived

Do not discard packaging until the claim or return has been resolved.

Claims and remedies are handled under our Refund Policy and applicable carrier procedures.

International orders

Where international shipping is offered, the customer is responsible for applicable customs duties, import taxes, brokerage fees, and destination-country requirements unless checkout expressly states otherwise.

We are not responsible for a customer’s failure to confirm whether a product may be lawfully imported into the destination country.


Section 7 — Oversized Shipping, Freight, and Local Pickup

Some merchandise cannot be shipped through ordinary parcel services.

Oversized parcel shipping

Large merchandise may be charged according to actual weight, dimensional weight, package size, destination, declared value, or carrier rules.

Estimated shipping charges may change if the product’s final packed size or weight differs materially from an earlier estimate.

Freight shipping

Very large or heavy products may require palletized or less-than-truckload freight service.

A freight quote may depend on:

  • Origin and destination
  • Pallet dimensions
  • Shipment weight
  • Freight classification
  • Residential or commercial delivery
  • Loading dock or forklift availability
  • Liftgate service
  • Inside delivery
  • Limited-access delivery
  • Delivery appointment
  • Other carrier accessorial services

A freight quote is not final until confirmed by us and incorporated into an authorized invoice, checkout, or written agreement.

You are responsible for providing accurate delivery information. To the extent permitted by law, you may be responsible for reasonable additional carrier charges caused by materially inaccurate or incomplete information concerning delivery access or required services.

Do not arrange return freight without our prior authorization.

When receiving freight, inspect the shipment where reasonably possible and note visible damage on the carrier’s delivery receipt. Failure to do so does not waive any right that cannot legally be waived, but prompt documentation may be necessary to pursue a carrier claim.

Local pickup

Products marked Local Pickup must be collected at the agreed location and time.

The pickup address may be provided after purchase or after pickup arrangements are confirmed. We do not publish a private storage or residential address unless necessary.

The customer is responsible for bringing:

  • Appropriate transportation
  • Sufficient loading assistance
  • Necessary straps, padding, tools, or equipment
  • Valid identification when requested

Customers should inspect local-pickup merchandise at pickup whenever reasonably possible.

Risk of loss transfers to the customer when the customer or the customer’s authorized representative accepts possession of the item.

If a customer fails to collect an item within an agreed pickup period, we may contact the customer to reschedule, cancel the order, or take another reasonable action consistent with the listing, written communications, and applicable law.


Section 8 — Returns and Refunds

Returns, refunds, transit-damage claims, change-of-mind returns, Final Sale merchandise, and Parts / Repair merchandise are governed by our Refund Policy at:

The Refund Policy is incorporated into these Terms.

Return eligibility may vary by product, condition, shipping method, and specific listing disclosure.

Material listing differences

A Condition Grade, Parts / Repair designation, Final Sale designation, or Testing Status does not permit us to materially misrepresent a product.

If an item arrives materially different from what was represented in the listing, contact:

Serialized and high-value returns

We may record:

  • Serial numbers
  • Partial serial numbers
  • Unique markings
  • Device identifiers
  • Internal component information
  • Security marks
  • Other item-specific documentation

A returned product must be the same physical item originally shipped.

A return may be denied, reduced, or otherwise handled as permitted by law if the product:

  • Has been substituted or swapped
  • Has a different serial number
  • Has had components removed or replaced
  • Has been materially altered
  • Has been damaged after delivery
  • Is missing included accessories
  • Has been account-locked, activation-locked, password-locked, or otherwise made unusable by the customer

Nothing in this section limits remedies that cannot legally be waived.


Section 9 — Vehicles and Other Titled Property

If Online Thrift Superstore offers a motor vehicle, motorcycle, trailer, or other titled property, that transaction may require:

  • A separate bill of sale
  • Title documents
  • Odometer disclosures
  • Salvage or branded-title disclosures
  • Identification
  • Separate payment instructions
  • Inspection arrangements
  • Pickup or transport arrangements
  • Additional transaction-specific terms

A vehicle page may constitute an invitation to inquire rather than an ordinary Add to Cart offer.

Vehicle or titled-property transactions are not governed by the standard 14-day merchandise return window unless expressly stated otherwise.

The specific vehicle listing, title disclosure, bill of sale, and other signed transaction documents control over these general Terms concerning that transaction.

Customers are encouraged to inspect vehicles or arrange an independent inspection before purchase where reasonably available.

Nothing in these Terms eliminates any disclosure, title, warranty, or consumer right that cannot lawfully be waived.


Section 10 — Intellectual Property

Except for third-party names, trademarks, product images, and other materials belonging to their respective owners, the Services and their original content, design, selection, arrangement, text, photographs, graphics, logos, videos, audio, and software are owned by or licensed to Online Thrift Superstore and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, nonexclusive right to access and use the Services for lawful shopping, account, customer-service, and related purposes.

Unless we provide prior written permission, you may not:

  • Reproduce or republish substantial portions of the Services
  • Modify or create derivative works from our original content
  • Sell or license access to the Services
  • Remove copyright, trademark, or proprietary notices
  • Use our photographs to advertise another physical item
  • Misrepresent an affiliation with Online Thrift Superstore
  • Use our name, logos, or branding in a confusing or unauthorized manner

Online Thrift Superstore names, logos, designs, slogans, and original brand elements are trademarks or other proprietary material of Online Thrift Superstore or its licensors.

Shopify names, logos, products, and services are trademarks of Shopify.

Apple, Fender, Sony, Lenovo, and other third-party names, logos, product names, and trademarks appearing in product listings belong to their respective owners. Their appearance does not imply sponsorship, affiliation, or endorsement unless expressly stated.

All rights not expressly granted are reserved.


Section 11 — Optional and Third-Party Tools

We may provide access to tools, integrations, payment methods, customer-account features, shipping calculators, marketplace services, or other functionality operated by third parties.

We may not monitor or control every aspect of those tools.

Third-party tools are made available subject to:

  • Their own terms and policies
  • Applicable technical limitations
  • Availability determined by their providers
  • Any disclosures displayed through the Services

Your use of an optional third-party tool is at your discretion and may require you to accept additional terms.

To the extent permitted by law, we are not responsible for a third-party tool’s independent acts, omissions, outages, security practices, or policy decisions.

New features and tools that we add to the Services are also subject to these Terms unless separate terms are provided.


Section 12 — Third-Party Links and Marketplaces

The Services may link to third-party websites, marketplaces, social platforms, payment providers, carriers, or other external services.

We do not control and are not responsible for the content, availability, policies, privacy practices, or accuracy of third-party websites.

If you leave our Services and use a third-party site, you do so subject to that third party’s terms and policies.

If you purchase an Online Thrift Superstore item through eBay or another third-party marketplace:

  • The transaction is also governed by the marketplace’s applicable rules and policies
  • Payment may be processed through the marketplace
  • Returns and disputes may need to be initiated through the marketplace
  • Marketplace-specific terms may control where they conflict with these Terms concerning that marketplace transaction

A link to a third-party service does not necessarily mean that we endorse every product, statement, or practice associated with that service.

Questions concerning a third party’s separate services should be directed to that third party.


Section 13 — Relationship with Shopify

Online Thrift Superstore is powered by Shopify, which enables us to provide the Services.

Sales and purchases made through our Store are made directly between you and Online Thrift Superstore.

Shopify is not the seller of Online Thrift Superstore merchandise and is not responsible for the condition, description, shipment, return, or performance of products sold by Online Thrift Superstore.

To the extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not responsible for injury, damage, loss, or disputes arising from products or transactions between you and Online Thrift Superstore.

Nothing in this section limits any responsibility Shopify may independently have under an agreement directly between you and Shopify or under non-waivable law.


Section 14 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy at:

Our Privacy Policy is incorporated into these Terms.

Because the Services are hosted and supported by Shopify, Shopify may collect and process personal information concerning your access to and use of the Services.

Information may also be provided to service providers involved in:

  • Payment processing
  • Fraud prevention
  • Order management
  • Shipping and fulfillment
  • Customer accounts
  • Email communications
  • Reviews
  • Offers
  • Analytics
  • Store operation

Some service providers may process information in jurisdictions other than the one in which you reside.

Section 15 — Feedback, Reviews, and Customer Content

You may submit reviews, ratings, photographs, comments, suggestions, messages, ideas, or other content, collectively “Customer Content.”

By submitting Customer Content, you grant Online Thrift Superstore a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, display, format, distribute, and promote that Customer Content in connection with operating, improving, and marketing the Services.

This license does not authorize us to publicly disclose private order information or an email address without permission.

You represent that:

  • You own or control the necessary rights to the Customer Content
  • The content is accurate to the best of your knowledge
  • Any incentives or compensation connected with the content have been disclosed
  • The content does not violate another person’s rights
  • The content is not unlawful, fraudulent, defamatory, abusive, obscene, or misleading
  • The content does not contain malware or harmful code

You may not:

  • Submit a review using another person’s identity
  • Falsely claim to have purchased a product
  • Submit fabricated or manipulated customer photographs
  • Include private information about another person without authorization
  • Use reviews to threaten, extort, or demand an improper benefit

A Verified Purchase designation is applied only when our systems associate the review with an eligible transaction.

We may moderate, decline, remove, or archive Customer Content for reasons including:

  • Spam
  • Fraud
  • Irrelevance
  • Illegal content
  • Threats or harassment
  • Personal information
  • Intellectual-property infringement
  • Technical problems
  • Violation of these Terms

We do not guarantee that every submission will be published or remain published.

We are not obligated to compensate you or respond to Customer Content unless separately agreed.


Section 16 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain errors or omissions relating to:

  • Product descriptions
  • Condition information
  • Testing information
  • Included accessories
  • Photographs
  • Prices
  • Promotions
  • Offer amounts
  • Shipping charges
  • Delivery estimates
  • Product specifications
  • Availability
  • Inventory quantities

We may correct or update inaccurate information.

We may also decline or cancel an order or offer affected by a material error.

We will not use this section to avoid a specific factual representation after knowingly completing a transaction based on that representation.

If we cancel an order because of an error after payment has been collected, we will issue an appropriate refund to the original payment method.


Section 17 — Prohibited Uses

You may use the Services only for lawful purposes.

Except as expressly permitted under Section 18, you may not use or access the Services:

  • In violation of any applicable law or regulation
  • To commit or facilitate fraud
  • To use stolen or unauthorized payment information
  • To impersonate another person or entity
  • To provide materially false or misleading information
  • To infringe intellectual-property, privacy, publicity, or other legal rights
  • To harass, threaten, abuse, defame, or unlawfully harm another person
  • To transmit malware, viruses, malicious code, or destructive data
  • To spam, phish, pharm, pretext, or send unauthorized solicitations
  • To interfere with the Services or another customer’s use
  • To bypass access, security, fraud-prevention, rate-limit, or authorization controls
  • To manipulate prices, discounts, offers, inventory, reviews, or checkout links
  • To submit fraudulent or abusive Name Your Price offers
  • To collect personal information about others without authorization
  • To gain unauthorized access to accounts, systems, databases, or administrative functions
  • To reproduce, scrape, extract, sell, or exploit substantial parts of the Services without authorization
  • To conceal the origin of automated access
  • For any purpose reasonably likely to harm Online Thrift Superstore, Shopify, our providers, or our customers

We may investigate suspected violations and may restrict, suspend, or terminate access when reasonably necessary.


Section 18 — Automated Access and Agents

For this section, an “Agent” means software that acts autonomously or semi-autonomously on behalf of a person or entity.

An Agent may access the Services only when:

  • Access is expressly permitted by us
  • Access is permitted through published technical instructions
  • The Agent complies with robots directives and applicable rate limits
  • The Agent accurately identifies itself where technically appropriate
  • The Agent does not conceal its automated nature
  • The Agent does not bypass security, CAPTCHAs, authentication, access controls, or other restrictions
  • The Agent does not submit offers, reviews, orders, or account actions without valid authorization
  • The Agent complies with these Terms and applicable law

We may limit or block automated access at any time.

No Agent may continue accessing the Services after we have expressly instructed it or its operator to stop.


Section 19 — Suspension and Termination

Termination does not eliminate obligations or amounts that arose before termination.

are sold with the disclosed faults and the possibility of additional unknown faults, to the fullest extent permitted by law.

No promise is made that such an item:

  • Can be repaired
  • Is economically repairable
  • Contains any particular functioning component
  • Is safe to operate without inspection
  • Will perform a specific function

Other warranties

  3. A promotion-specific term
  4. The Refund Policy, Privacy Policy, or Shipping & Freight Policy for matters specifically governed by that policy
  5. These Terms

A more specific disclosure controls over a more general statement concerning the same subject, except that no disclosure may eliminate a right that cannot legally be waived.


Section 25 — Assignment

You may not assign or transfer your account or your rights and obligations under these Terms without our prior written consent.
